Terms and conditions of the
Behavioral Analysis service
and its derivative products

SCOPE: Applies to all services and products provided by our company, present and future.

This is a Legal Notice that describes the nature and purpose of the Behavioral Analysis services and products offered to customers and aims to exclude or limit the legal liability of our company. This service is provided without warranties of any kind, either express or implied that are understood or can be derived from it, directly or indirectly. By registering for or using any of our services or products, you agree to be bound by the following Terms and Conditions of Service.

Behavioral Analysis is a discipline that helps people understand themselves better and achieve their goals in different areas of life. The Analyst is a facilitator who helps the client to channel solutions to their problems, but their service does not represent a therapy and is not used to treat mental or emotional difficulties, or those that may arise from the latter.

If you have mental or emotional difficulties, you should seek help from a mental health professional. It is not intended to replace the therapeutic service of a psychologist or any other type of medical or psychological treatment.

The Behavioral Analysis service may include conversation sessions, reflection exercises or other activities, according to the criteria of the Behavioral Analyst, and its main objective is to promote Self-Knowledge and stimulate Personal Development.

The method used is based on the scientific theory of the five-Character Structures and is derived from the postulates of psychologists Sigmund Freud, Wilhelm Reich and Alexander Lowen. The Analyst is authorized, trained, and certified to provide his services and products in accordance with the quality standards of the creator and legal protector of the method: the company “O Corpo Explica Cursos e Treinamentos LTDA” from Brazil. The conduct and procedure of the Analyst are regulated by their respective Code of Ethics issued by this company.

The service is governed for all purposes by the Laws of the Republic of Costa Rica, as applicable. Our company is committed to complying with all applicable laws and regulations to offer a quality and legally established service; as well as not to commercialize the information that emerges from the analysis, which solely and exclusively will be used for the contracted service and will be handled with the highest degree of confidentiality.

LIMITATIONS OF LIABILITY: Behavioral Analysis is an informative and educational service. The recommendations provided should not be construed an abolute mandate. The person analyzed is solely responsible for the use, interpretation, and communication to third parties of the information provided in this service.

EXCLUSION OF LIABILITY: Our company will not be liable for any direct, indirect, incidental, consequential, punitive or any other damages that may result from the use of our services or products, whether due to malfunctions, errors, or any other circumstances. The customer uses the service or product at his own risk and must assume responsibility for any results arising from its use.

This exclusion of liability includes, without limitation, any loss of profits, loss of data, business interruption or any other commercial damage or loss that may result from the use or inability to use our services or products.

It is important that the customer follows the guidance provided, at the time we provide our services or products, carefully to ensure their safety and effectiveness. Please be vigilant and consider the guidelines and recommendations that are included with each service or product before and during the process. If you have any doubts or questions about the use of our services or products, please do not hesitate to contact us for more information.

The Behavioral Analyst is not responsible for problems arising during the use of the services or products. We make every effort to provide quality service and help our clients achieve their goals, but we cannot guarantee results or control all factors that may affect the Analysis process. Our services or products may have some risks associated with their use. Although we consider the risks to be very low, we cannot guarantee that they will not exist completely.

In case of problems or incidents during the use of the service, the client must immediately inform the company or the Analyst so that we can take possible measures to solve the problem in the best way. The total liability of the company in monetary terms will never exceed the amount paid by the client under any circumstances.

DISPUTE RESOLUTION: The client is expected to behave ethically, morally, in good faith and in accordance with good customs. If these conditions are not met, the company reserves the right to interrupt the provision of services or products partially or permanently, without a refund. The client does not have the right to cancel the services twenty-four hours before the date and time previously agreed. If you cancel the service less than twenty-four hours in advance, you will not be entitled to a payment reversal.

On the other hand, the maximum number of reschedules allowed to appointments already scheduled is limited to two. After these two times, the company will have the discretion to accept or deny a third rescheduling, without this implying the right to receive a refund. The company strives to be flexible and adapt to the needs of its customers, but it must also protect its liability and interests.

The client must attend all their sessions on time. If the customer arrives up to ten minutes late without prior notice and without communicating during that period, he/she loses the right to reschedule and request a refund of the money paid.

The customer is responsible for ensuring that their attendance is punctual and for notifying us in advance in case of delay or inability to attend. We reserve the right to deny rescheduling or refund. However, if it is considered that a refund of money should be made by us, the company will have a maximum of up to thirty business days to carry out this operation.

If you want the service to be performed in a specific physical location, you must provide this address in detail in our request form (only applies to group and business packages). Please note that we reserve the right to accept or reject this option depending on our feasibility. If we decide to decline, we will contact you.

We acknowledge the personal and individualized nature of the services provided by our company. Therefore, we request that you maintain the confidentiality of any information, method, or strategy provided as part of our services. This provision aims to safeguard the integrity of our processes and ensure the privacy of shared information during the provision of services.

If you experience any dissatisfaction, disagreement, or discord with our services, we ask you to communicate it exclusively to us. We aim to address any concerns efficiently and effectively, and to achieve this, we encourage discussing any issues directly with our designated representatives. In the event of any issues or disputes regarding our services or products, both parties agree to attempt to resolve them amicably.

You commit to refraining from publicly expressing any criticism, complaint, or negative comments related to our services. This measure is implemented to preserve the reputation of our company. Any public expression of dissatisfaction may have legal consequences, including the possibility of seeking compensation for damages that may affect our image and reputation.

These provisions regarding confidentiality and restriction on the public expression of dissatisfaction will remain applicable even after the completion of the service provision. This commitment aims to maintain long-term confidentiality and protect our business interests.

PRIVACY AND USE OF PERSONAL DATA: All data generated for the client is confidential. We respect the privacy of our customers and take reasonable security measures to protect our customers’ information and ensure its confidentiality. The Client undertakes never to disclose to third parties the information generated by our company under any circumstances, respecting our intellectual property.

We use customer information only for the contracted services. Therefore, we only collect the strictly necessary information. We will not use the information shared by you for marketing or advertising purposes without your consent.

CHANGE OF TERMS AND CONDITIONS: We reserve the right to change the terms and conditions of this Legal Notice at any time and without prior notice. If there are significant changes, we will notify the customer by email or on our website. By using our services or products, you agree to be bound by the then-current terms and conditions.

If you have questions, please do not hesitate to contact us. The customer is responsible for reviewing this document regularly to be aware of any changes or updates. If the client continues to use the services or products of Behavioral Analysis after a new version is published, it will be understood that he/she accepts the changes that may occur.

Stating who subscribes that this Agreement and consent represents absolutely and totally their will, regarding this service relationship, and that consequently it leaves without legal value or effect any other document, understanding and any verbal or written agreement even with third parties, that exists or has existed prior to this date.
